CLE Description: In a February 2017 memo implementing President Trump’s Executive Order titled “Border Security and Immigration Enforcement Improvements,” the Department of Homeland Security (DHS) announced that it would target for immigration enforcement and federal criminal prosecution the family members of unaccompanied children (UCs) who had “directly or indirectly—facilitate[d] the illegal smuggling or trafficking of an alien child into the United States.” In the summer of 2017, the DHS arrested and detained caretakers, or “sponsors,” of UCs across the country with various immigration and criminal consequences. It was reported that some 400 arrests were conducted as part of this enforcement action as of August 18, 2017; it remains to be seen what further enforcement actions will be taken as part of the DHS’s announced plan to target the caretakers of UCs whom it alleges have participated in smuggling. During this 2.5-hour CLE hosted by Lindquist & Vennum, presenters will discuss current trends in this area and the immigration and criminal consequences that can result from smuggling allegations. Participants will learn strategies for conducting timely legal screenings and risk advisals for this vulnerable population to try to prevent or mitigate harm to families. The presenters will discuss specific steps to consider in the event that a family member of a UC is targeted for enforcement. Participants will also have the opportunity to sign up to conduct limited-scope pro bono screenings and advisals for family members of UCs in need of legal assistance.
